In situations where the causes of business distress are incurable and a turnaround is not an option, we identify, negotiate, and implement business plans to mitigate losses for all stakeholders and claimants. We have developed and refined systems and procedures necessary to operate distressed businesses, locate assets, administer collections and disbursements, sell unique and/or geographically disbursed assets, and expedite disbursements to creditors. Marcum is also accomplished in negotiating out-of-court reorganizations and is particular adept at negotiating discounted payoffs with institutional lenders.
Fiduciary appointments require specialized knowledge in estates' industries and asset types. Barry Mukamal, a Chapter 7 Panel Trustee, heads this practice whose professionals have significant experience and qualifications in more than 30 industries, including real estate construction and development, manufacturing and distribution, healthcare, hospitality, aviation and trucking. Marcum's partners have substantial experience as court appointed receivers or other fiduciaries on interrupted real estate projects and distressed operating businesses.
